Case note on Achmea matter

The German Constitutional Court (BVerfG) has dismissed two constitutional complaints filed by the Dutch insurance company Achmea B.V., effectively closing the German chapter of the Achmea saga. In their case note in the latest issue of the German Arbitration Journal (SchiedsVZ), Dr Christian Johannes Wahnschaffe and Dr Edward L. Rensmann examine the Court’s reasoning on the primacy of the law of the European Union and explore potential implications for the greater arbitration community.
